Addressing Family Law and Parental Drug Use 

Supporting Statement The rise in drug use among parents poses significant risks to children’s welfare in our communities. It is crucial for family law to adapt to these challenges, ensuring that children’s best interests are prioritised. This proposal aims to establish a framework for assessing parental drug use in family law cases, emphasising rehabilitation, support, and protective measures for affected children. 

 Objectives 

1. Assess Parental Drug Use

Introduce standardised protocols for evaluating the impact of parental drug use on child welfare during custody and visitation hearings. 

2. Provide Supportive Resources

Facilitate access to rehabilitation and counselling programs for parents struggling with addiction. 

3. Enhance Training for Family Law Professionals Develop training programs for judges and legal practitioners on the impacts of substance abuse on family dynamics. 

4. Establish Clear Guidelines

Create guidelines for custody arrangements that prioritise child safety while considering parental rehabilitation potential. 

5.Evaluate Current Guidelines

Review existing family law guidelines and court rulings regarding parental drug use and its impact on custody and welfare. 

6. Assess Impact of Drug Testing Data

Analyse implications of positive drug testing results in judicial decisions affecting children’s outcomes.
